Please take the time to read and understand the terms and conditions below. You will get the greatest benefit from our time together if you are aware of these terms. Everything is subject to change at the owner's discretion.

The Happiness Index LLC is owned and operated by Lee Anne Russell. These terms set forth the terms and conditions under which you may use our website and services. This website offers visitors access to life coaching services. You acknowledge that you have read, understood, and agree to be bound by these terms by accessing or using her services website.

All original material on the Happiness Index site is subject to copyright and other intellectual property rights. All original materials may not be used without the written permission of the owner.

No Unlawful or Prohibited Use

As a condition of your use of the Site, you warrant that you will not use the Site for any purpose that is unlawful or prohibited by these Terms, conditions, and notices.

You will comply with all applicable laws, including, but not limited to, privacy laws, intellectual property laws, export control laws, regulatory requirements, etc.
You will use the Site in a professional manner, and you may not use the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site.
You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided through the Site.
You will not use any robot, spider, other automatic device, or manual process to monitor or copy the Site or the contents or information contained therein without our prior express written consent.
You agree that you will not use any device, software, or routine to interfere or attempt to interfere with the proper working of the Site or any transaction being conducted through the Site.
The information you provide to us: (i) shall not contain any viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data, or information; and (ii) shall not create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers.
You agree that you will not copy, reproduce, alter, modify, create derivative works, or publicly display any content from the Site without our prior express written consent or that of the appropriate third party.
You may not print, download, and/or use the underlying HTML, text, audio clips, video clips, and other content that is made available to you on this Site for anything other than your personal information.
In the event you gain access to information or material not intended to be accessed by you, you agree that you will immediately notify us, destroy all copies of such information in your possession, and not forward such information to any third parties. Modification of these Terms

We reserve the right, in our sole discretion, to change, modify, add, or remove the Terms, conditions, and notices under which the Site is offered. It is your responsibility to check periodically for any changes we may make to these Terms. Your continued use of this Site following the effective date of any changes to these Terms or other policies means you accept and consent to the changes.

Links to Third Party Sites and Offerings

The Site may contain links to other websites (“Linked Sites”). The Linked Sites are not under our control, and we are not responsible for the contents of any Linked Site, including, without limitation, any link contained in a Linked Site or any changes or updates to a Linked Site. We are providing these links to you only for informational purposes, and the inclusion of any link does not imply endorsement by us of any products mentioned on the site or any association with its operators. We reserve the right to remove any links to the Site from third-party websites.

As a client of Lee Anne Russell, your information is confidential and will not be given or sold to a third party. Lee Anne Russell will not share with anyone else that you are in a coaching relationship without your full consent.

Payment

If paying by credit/debit card, you give The Happiness Index LLC permission and authorization to automatically charge your credit or debit card as payment for our Services. You agree to only purchase these Coaching Services for yourself or for another person for whom you are legally permitted to do so. When making a purchase for a third party that requires you to submit the third party’s personal or financial information to us, you represent that you have obtained his/her consent to provide such third party’s personal information.

Refund, Return and Cancellation policy

All notices of cancellation of coaching services must be in writing and delivered by email to TheHappinessIndex.biz@gmail.com. A cancellation notice will be deemed given on the date Lee Anne Russell receives it. No refunds, credits, or transfers are available for no-shows.

Terms of Coaching

The Coaching Programs are created and sold as whole packages. If you are a coaching client, the number of sessions is set as part of the package you purchase. Unused sessions due to quitting the program may not be eligible for a refund, credit, or transfer. Additional sessions may be discussed at the completion of the initial package.

Scheduling

The client’s Individualized Life Coaching Sessions are scheduled directly between you and Lee Anne Russell. If you cannot attend a scheduled session, inform Lee Anne as soon as possible, preferably within 48 hours in advance. Emergencies happen, but please reach out and communicate with Lee Anne in order to reschedule. If Lee Anne is not informed of the cancellation within 48 hours, it is deemed a forfeit of that paid session. Rescheduling can occur via phone or email.

Coaching Agreement

Lee Anne Russell’s main goal is to support you and give you access to tools to achieve the results you desire.
Lee Anne Russell will offer suggestions, tools, tips, and knowledge based on her experience, connections, and training.
The client is ultimately responsible for making the changes necessary to achieve those goals based on the decisions and plans made with Lee Anne.
By reading these terms, the client agrees and acknowledges that the Coach is not a licensed therapist, psychologist, psychiatrist, or other health or legal professional.
Lee Anne Russell will not share with anyone else that you are in a coaching relationship without your full consent.

Use of Communication Services

The Site may contain bulletin board services, chat areas, news groups, forums, communities, and/or other message or communication facilities designed to enable you to communicate within a group (collectively, "Communication Services"). You agree to use the Communication Services only to post, send, and receive messages and material that are proper and related to the particular Communication Service.

By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:

defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
publish, post, upload, distribute, or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material, or information.
upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the Site or another’s computer.
advertise or offer to sell or buy any goods or services for any business purpose.
conduct or forward surveys, contests, pyramid schemes, or chain letters.
download and/or distribute any file posted by another user of the Communication Services that you know, or reasonably should know, cannot be legally distributed in such manner.
restrict or inhibit any other user from using and enjoying the Communication Services.
violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.
harvest or otherwise collect information about others, including email addresses, without their consent.
violate any applicable laws or regulations.

Please keep in mind that we are under no obligation to monitor the communication services. However, we reserve the right, in our sole discretion, to review all activity and materials related to the Communication Services and to stop activity and remove any materials at any time, for any reason, without notice to you. We also reserve the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

Disclaimer

The purchase of sessions from The Happiness Index does not guarantee results, as this is a partnership. Our sessions are not intended to replace health or medical care.If you require health, medical, psychiatric, and/or psychological care, you are advised to retain the services of a licensed medical professional. The sole purpose of the Company is to provide coaching services to an individual.

All Company trademarks that appear on the Site are the exclusive property of the Company. The trademarks, trade names, trade dress, logos, and associated services represented on this Site are protected under the laws of the United States and international law, and their display on this Site does not convey or create any license or other rights in these trademarks, trade names, trade dress, or associated services. Any use of them without the prior written authorization of the Company or the relevant trademark owner is strictly prohibited.

Any third-party trademarks mentioned on this Site that are not those of the Company are the trademarks of their respective owners. The display of these trademarks or trade names on this Site does not convey or create any license or other rights in these trademarks or trade names. Electronic Signature

You represent and warrant that you have the legal right, power, and authority to agree to the Terms on behalf of yourself while participating in the Site. You further agree that your use constitutes an electronic signature as defined by the Electronic Signatures in Global and National Commerce Act ("E-Sign") and the Uniform Electronic Transactions Act ("UETA"), and that you have formed, executed, entered into, accepted the terms of, and otherwise authenticated the Terms and acknowledged and agreed that these Terms are an electronic record for purposes of E-Sign, UETA, and the Uniform Computer Information Transactions Act and as such are completely valid, have legal effect, are enforceable, are binding, and are non-refutable by you.
